{"id":68489,"date":"2018-05-31T14:58:03","date_gmt":"2018-05-31T21:58:03","guid":{"rendered":"http:\/\/www.mayagonzalez.com\/blog\/?p=68489"},"modified":"2020-02-07T12:53:45","modified_gmt":"2020-02-07T20:53:45","slug":"gender-work-stolen-childrens-book-industry","status":"publish","type":"post","link":"http:\/\/www.mayagonzalez.com\/blog\/2018\/05\/gender-work-stolen-childrens-book-industry\/","title":{"rendered":"My Gender Work was Stolen in the Children&#8217;s Book Industry"},"content":{"rendered":"<h4><strong>Context is Everything<\/strong><\/h4>\n<p><strong>I was plagiarized twice in the same year by the same community.<\/strong> It was hard to wrap my brain around at first. After all, this is a community I felt some connection to. These were people I imagine to be well-intentioned parents and professionals. But now there are two kid\u2019s books that have stolen and misused my work without credit or attribution.<\/p>\n<p>After more than a year of dealing with the consequences I felt it was time to speak up.<\/p>\n<p>Nearly all of the main concepts of my <u><a href=\"http:\/\/www.reflectionpress.com\/our-books\/gender-now-coloring-book\/\" target=\"_blank\" rel=\"noopener noreferrer\">Gender Now Coloring<\/a><\/u> and <u><a href=\"http:\/\/www.reflectionpress.com\/our-books\/gender-now-activity-bookschool-edition\/\" target=\"_blank\" rel=\"noopener noreferrer\">Activity Books<\/a><\/u> were lifted, somewhat modified and put in <u>The Gender Identity Workbook for Kids<\/u> (Kelly Storck, New Harbinger Publications) and both the author and the editor were aware of it. Kelly Storck accidentally shared emails with me between her and her editor that outlined what was going on and what they were doing including the style in which the author should contact me.<\/p>\n<p>It was through reading these emails that I began to understand another related experience of plagiarism that happened earlier in the year. In this case, the children\u2019s book <u>Who Are You? The Kid\u2019s Guide to Gender Identity<\/u> (Brook Pessin-Whedbee, Jessica Kingsley Publishers) plagiarized the name and concentric circle concept of <a href=\"http:\/\/www.mayagonzalez.com\/blog\/2018\/03\/gender-month-week-five-part-two-holistic-self-gender-wheel\/#gender-wheel-history\" target=\"_blank\" rel=\"noopener noreferrer\">The Gender Wheel<\/a> from my <u>Gender Now<\/u> books.<\/p>\n<p>In my nearly 25 years in the children&#8217;s book industry, I have never experienced anything like this. I\u2019m a queer, Chicanx author\/illustrator and I\u2019m also a parent and educator\/activist. I\u2019ve authored and\/or illustrated over 20 multicultural children\u2019s books with publishers that include Children\u2019s Book Press, Lee &amp; Low, Barefoot Books and more. 9 years ago, I also co-founded my own small Indie press, <a href=\"http:\/\/www.reflectionpress.com\/about-us\/mission-values\/\" target=\"_blank\" rel=\"noopener noreferrer\">Reflection Press<\/a>, with my partner Matthew where we first published Gender Now.<\/p>\n<p><strong><u>Who Are You? The Kid\u2019s Guide to Gender Identity<\/u><\/strong><em>(Brook Pessin-Whedbee, Jessica Kingsley Publishers)<\/em><strong> and <u>The Gender Identity Workbook for Kids<\/u><\/strong><em>(Kelly Storck, New Harbinger Publications)<\/em><strong> are connected in multiple ways<\/strong>, but I only recently found that the first testimonial in Kelly Stork\u2019s book is by Brook Pessin-Whedbee. Although I don\u2019t completely know what all of these connections mean, I do know that context means everything, so they\u2019re noteworthy.<\/p>\n<div style=\"border-left: 2px solid #000;\">\n<ol style=\"list-style-position: outside; margin-left: 45px; font-size: 1.1em;\">\n<li style=\"margin-bottom: 15px;\">Both books are authored by straight, white, cisgender women who are parents and work with gender professionally.<\/li>\n<li style=\"margin-bottom: 15px;\">Both authors are tied to the Gender Spectrum conference\/community in the SF Bay Area during the same time period that I was presenting my Gender Now curriculum.<\/li>\n<li style=\"margin-bottom: 15px;\">Both plagiarized my <u>Gender Now<\/u> work.<\/li>\n<li>Neither author nor publisher properly cites, credits, or acknowledges the source work from which their books are drawn.<\/li>\n<\/ol>\n<\/div>\n<h4><strong>My Gender Work and Presentations\/More Context<\/strong><\/h4>\n<p><a href=\"http:\/\/www.reflectionpress.com\/our-books\/gender-now-coloring-book\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-68597 size-full\" src=\"http:\/\/www.mayagonzalez.com\/blog\/wp-content\/uploads\/2018\/05\/gender-now-coloring-and-activity-books-web.jpg\" alt=\"\" width=\"600\" height=\"419\" srcset=\"http:\/\/www.mayagonzalez.com\/blog\/wp-content\/uploads\/2018\/05\/gender-now-coloring-and-activity-books-web.jpg 600w, http:\/\/www.mayagonzalez.com\/blog\/wp-content\/uploads\/2018\/05\/gender-now-coloring-and-activity-books-web-300x210.jpg 300w\" sizes=\"(max-width: 600px) 100vw, 600px\" \/><\/a><\/p>\n<p>My gender work for kids began with my <u><a href=\"http:\/\/www.reflectionpress.com\/our-books\/gender-now-coloring-book\/\" target=\"_blank\" rel=\"noopener noreferrer\">Gender Now Coloring Book<\/a><\/u> (2010) and <u><a href=\"http:\/\/www.reflectionpress.com\/our-books\/gender-now-activity-bookschool-edition\/\" target=\"_blank\" rel=\"noopener noreferrer\">School Edition Activity Book<\/a><\/u> (2011) both published by Reflection Press. In them I gathered queer and indigenous scholarship from multiple disciplines \u2014nature, global cultures and history with lots of games and coloring\u2014 all in support of <a href=\"http:\/\/www.mayagonzalez.com\/blog\/2018\/03\/gender-month-week-five-part-two-holistic-self-gender-wheel\/#gender-wheel-history\" target=\"_blank\" rel=\"noopener noreferrer\">The Gender Wheel<\/a>, a holistic tool to understand gender for kids. The main premise of my Gender Now curriculum is \u201cplay to learn.\u201d<\/p>\n<p>In 2017 I further developed my gender work with the picture books,\u00a0<a href=\"http:\/\/www.reflectionpress.com\/our-books\/they-she-he-me\/\" target=\"_blank\" rel=\"noopener noreferrer\"><u>They, She, He, Me: Free to Be<\/u><\/a> coauthored with Matthew and\u00a0<a href=\"http:\/\/www.reflectionpress.com\/our-books\/the-gender-wheel\/\" target=\"_blank\" rel=\"noopener noreferrer\"><u>The Gender Wheel: a Story about Bodies and Gender for Every Body<\/u><\/a>.<br \/>\n<a href=\"http:\/\/www.reflectionpress.com\/product-tag\/gender-now\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-full wp-image-68675\" src=\"http:\/\/www.mayagonzalez.com\/blog\/wp-content\/uploads\/2018\/05\/gender-wheel-pronoun-covers-web-600px-new.jpg\" alt=\"They She He Me and The Gender Wheel published by Reflection Press\" width=\"600\" height=\"339\" srcset=\"http:\/\/www.mayagonzalez.com\/blog\/wp-content\/uploads\/2018\/05\/gender-wheel-pronoun-covers-web-600px-new.jpg 600w, http:\/\/www.mayagonzalez.com\/blog\/wp-content\/uploads\/2018\/05\/gender-wheel-pronoun-covers-web-600px-new-300x170.jpg 300w\" sizes=\"(max-width: 600px) 100vw, 600px\" \/><\/a><\/p>\n<p><strong>My work rises from an inclusive perspective and provides tools to understand gender rooted in nature outside of a Western cultural framework.\u00a0<\/strong>This is important to me as a queer Chicanx. You can see the breadth and depth of this work and its connection to both me and The Gender Wheel in my <a href=\"http:\/\/www.genderwheel.com\/5-part-gender-series\/\" target=\"_blank\" rel=\"noopener noreferrer\">Gender Blog Series<\/a>.<\/p>\n<p>I have always taught this three tiered, nested perspective of Nature, Global Cultures and History when presenting my work. Matthew and I also worked with Gender Spectrum on their <a href=\"https:\/\/www.dropbox.com\/s\/lqwpo8dqguabk5e\/The%20Gender%20Inclusive%20School%20copy%204.pdf?dl=0\" target=\"_blank\" rel=\"noopener noreferrer\">school curriculum<\/a>\u00a0from 2011-2012 which included activities from <a href=\"http:\/\/www.reflectionpress.com\/our-books\/gender-now-coloring-book\/\" target=\"_blank\" rel=\"noopener noreferrer\"><u>Gender Now<\/u><\/a>. We came to understand that we had different philosophical perspectives and teaching styles around gender, however we were appreciative of the work Gender Spectrum was doing to support parents and schools.<\/p>\n<h4><strong>Plagiarism, Distortion, and Erasure<\/strong><\/h4>\n<p>The plagiarism is unacceptable. But after having a chance to look through these books Matthew and I discovered that it wasn\u2019t just a matter of plagiarism. In the case of <u>Who Are You? The Kid\u2019s Guide to Gender Identity<\/u> (Brook Pessin-Whedbee, <strong>Jessica Kingsley Publishers<\/strong>), the text on and describing The Gender Wheel is written in a particularly white and Western way. As Chicanx drawing from my experience and studies outside of a Western frame, this not only distorts and damages The Gender Wheel\u2019s origins and core meaning, it fully erases me as the creator.<\/p>\n<p>In the case of <u>The Gender Identity Workbook for Kids<\/u> (Kelly Storck, <strong>New Harbinger Publications<\/strong>), the bulk of my Gender Now curriculum was taken and embedded in another book and distorted through a white and Western lens. All of my work and existence again erased.<\/p>\n<p><strong>The plagiarism and erasure have been disorienting and sobering about power dynamics in social justice work and the children\u2019s book industry;<\/strong> and the distortion now associated with The Gender Wheel has simply broken my heart and taken up more time and energy than I thought possible.<\/p>\n<p>If you want to learn more about the details of plagiarism in both of these books, <a href=\"http:\/\/www.mayagonzalez.com\/blog\/plagiarism-two-childrens-books-gender\/#\" rel=\"noopener\">you can go here<\/a>.<\/p>\n<h4><strong>The Authors and Their Publishers<\/strong><\/h4>\n<p>Our experience was not limited to the books alone. Matthew and I engaged both authors and their publishers with hopes of resolution.<\/p>\n<p>After a disheartening and difficult interaction with Brook Pessin-Whedbee and her press <strong>(Jessica Kingsley Publishers)\u00a0<\/strong>in London, an editor accidentally sent us this email:<\/p>\n<blockquote><p>\u201cSimon<br \/>\nThey obviously enjoy this how can we put a stop to it.<br \/>\nThanks Frank.\u201d<\/p><\/blockquote>\n<p>The idea that we were enjoying any part of this theft, or the exhausting process of trying to get the author and publisher to take responsibility for their actions, was as eye-opening as it was frustrating.<\/p>\n<p>After much back and forth and confronting Brook in person, they acquiesced to change the name to \u201cThe Interactive Wheel\u201d at their next reprinting. They maintain they did nothing wrong and would not take action to address the plagiarism or the damage done. It seems beyond them to simply acknowledge that a person of color created The Gender Wheel that they have now distorted and are promoting and profiting from.<\/p>\n<p><strong>Instant Help Books\/imprint of New Harbinger Publications, Inc.\u00a0<\/strong>By their own admission, a significant portion of Kelly Storck\u2019s book was not original work that just <em>happened to be similar<\/em>. Despite what the press would like to imagine, it cannot be treated the same as original work. The fundamental frame and format was consciously plagiarized. The most disconcerting piece is that it was not in part, but all of the fundamentals of my gender work while never offering to acknowledge or uplift\u00a0<u>Gender Now<\/u> as the source in any way.<\/p>\n<p>The only acknowledgement is to Diane Ehrensaft who wrote the introduction, and is given credit for her \u201cApples and Oranges\u201d Exercise.<\/p>\n<h4><strong>The Impact <\/strong><\/h4>\n<p><strong>Being \u2018columbused\u2019 hurts.<\/strong> More than I thought it would.\u00a0It ricochets and vibrates through my system and experience and speaks through my ancestors. My body, my work, my schedule, my family, my friends, my attitude, have all been impacted. It\u2019s changed me. It is only after walking through and around this wicked little time and hearing from nearly every corner other experiences of plagiarism, especially for Indigenous, POC and Queer\/Trans people, that I see how this fits into my larger body of work. And why it\u2019s important to come forward with clarity.<\/p>\n<p><strong>It takes conscious, active awareness to not participate in privilege and power-over, but instead create real and effective change and equity for our children, our society and each other.<\/strong> We know this to be true with regards to racism in a country built on colonization and white supremacy. The same criteria must be applied to gender and sexuality for the same reasons.<\/p>\n<p>I\u2019ll be honest, it\u2019s hard that these books are still<a href=\"http:\/\/www.reflectionpress.com\/download\/251247\/\"><img decoding=\"async\" loading=\"lazy\" class=\"alignright size-full wp-image-68693\" src=\"http:\/\/www.mayagonzalez.com\/blog\/wp-content\/uploads\/2018\/05\/download-bookmark-who-are-you-gender-identity-workbook-plagiarism-web-print2.jpg\" alt=\"Download bookmark for Who Are You Kids Guide to Gender Identity Pessin-Whedbee and Gender Identity Workbook for Kids Storck\" width=\"302\" height=\"590\" srcset=\"http:\/\/www.mayagonzalez.com\/blog\/wp-content\/uploads\/2018\/05\/download-bookmark-who-are-you-gender-identity-workbook-plagiarism-web-print2.jpg 302w, http:\/\/www.mayagonzalez.com\/blog\/wp-content\/uploads\/2018\/05\/download-bookmark-who-are-you-gender-identity-workbook-plagiarism-web-print2-154x300.jpg 154w\" sizes=\"(max-width: 302px) 100vw, 302px\" \/><\/a><\/p>\n<p>on the market,<\/p>\n<p>in libraries <em>(San Francisco Public Library alone has 29 copies of Who Are You?)<\/em>,<\/p>\n<p>getting on the same book lists as my books in the industry (Bank Street) and in the LGBTQ community.\u00a0<em>(Bank Street has been made aware of the situation, but without public pressure has currently chosen not to take action)<\/em><\/p>\n<p>These books are still supporting the authors and their presses as they erase me and my work.<\/p>\n<p>A friend asked what I wanted as restitution. I laughed. I knew when I began this journey, but I\u2019ve lost track of it through having to stay keenly focused on the truth and keeping my head above water. I find myself more concerned with the big picture and the big conversations. <strong>Is it a survival response knowing that any immediate restitution for myself is highly unlikely in a situation like this?<\/strong> Absolutely.<\/p>\n<p><strong>I have to keep moving forward. I have to find what motivates me. Community and a vision of a more equitable, humane world are my drive.<\/strong><\/p>\n<p>I\u2019m sharing so others like me can prepare for plagiarism and intellectual theft. It\u2019s that common. And if we can get out in front of this kind of thing as a community hopefully more of us can retain ownership of our work.<\/p>\n<h4><strong>A Call to Action\u00a0 <\/strong><\/h4>\n<p><a href=\"http:\/\/www.reflectionpress.com\/childrens-books-radicalact\/#infographics\" target=\"_blank\" rel=\"noopener noreferrer\"><img decoding=\"async\" loading=\"lazy\" class=\"alignright wp-image-68427\" src=\"http:\/\/www.mayagonzalez.com\/blog\/wp-content\/uploads\/2018\/04\/2017-statistics-lgbtq-books-1200px-Apr2018.jpg\" alt=\"2017 LGBTQ children's books statistics inforgraphic\" width=\"450\" height=\"253\" srcset=\"http:\/\/www.mayagonzalez.com\/blog\/wp-content\/uploads\/2018\/04\/2017-statistics-lgbtq-books-1200px-Apr2018.jpg 1200w, http:\/\/www.mayagonzalez.com\/blog\/wp-content\/uploads\/2018\/04\/2017-statistics-lgbtq-books-1200px-Apr2018-300x169.jpg 300w, http:\/\/www.mayagonzalez.com\/blog\/wp-content\/uploads\/2018\/04\/2017-statistics-lgbtq-books-1200px-Apr2018-768x432.jpg 768w, http:\/\/www.mayagonzalez.com\/blog\/wp-content\/uploads\/2018\/04\/2017-statistics-lgbtq-books-1200px-Apr2018-1024x576.jpg 1024w\" sizes=\"(max-width: 450px) 100vw, 450px\" \/><\/a>This is about a shift in thinking and doing. <strong>LGBTQI+ children\u2019s books have the most <a href=\"http:\/\/www.mayagonzalez.com\/blog\/2018\/04\/my-story-your-story-their-story-who-gets-to-tell-it-and-why\/\" target=\"_blank\" rel=\"noopener noreferrer\">severe power imbalance for first\/own voice<\/a>, and lack a clear social justice frame as criteria.<\/strong> This is historically and socially relevant and impacts what is considered respectable\/acceptable, and profitable in the industry and society.<\/p>\n<p>It is the same song I\u2019ve been singing for 25 years in the industry about race and ethnicity, which after countless voices in the field for decades upon decades, is finally finding more traction. But add to that song LGBTQI+ and I find there are fewer and fewer voices willing to come forward and sing OUT.<\/p>\n<p><strong>So it is that right now, I\u2019m asking everyone within the range of my voice to share this.<\/strong>\u00a0We can do better. <strong>We must do better.<\/strong><\/p>\n<h5><strong>Now is the time to make deep change.<\/strong><\/h5>\n<p><em>Who\u2019s writing our stories and <u>how<\/u>?<\/em><\/p>\n<p><em>Are equitable numbers of Indigenous and POC queer\/trans\/intersex first voices <u>included<\/u> in the social justice conversation in children\u2019s books?<\/em><\/p>\n<p><em>Are queer\/trans\/intersex kids able to see <u>genuine<\/u> reflection, experience, culture and wisdom in their books?<\/em><\/p>\n<p><em>What stories are most prevalent?<\/em><\/p>\n<p><em>What stories are most rare?<\/em><\/p>\n<p><em>Are Indigenous and POC queer\/trans\/intersex children\u2019s book authors, stories and perspectives being <u>uplifted<\/u> and receiving love and respect?<\/em><\/p>\n<p>These are the questions we must ask over and over and over again until change is real.<\/p>\n<h5 style=\"text-align: left;\"><strong>And if you\u2019d like to make your voice heard in relation to these two books,<\/strong><\/h5>\n<p>You can contact the publishers: <a href=\"mailto:customerservice@newharbinger.com\">New Harbinger Publications<\/a> and <a href=\"mailto:hello@jkp.com\">Jessica Kingsley Publishers<\/a><\/p>\n<p>Or <strong><a href=\"http:\/\/www.reflectionpress.com\/download\/251247\/\">download bookmarks<\/a> to slip between the pages of either book<\/strong> at the public library, bookstores, conferences, schools, etc.<\/p>\n<p>You can also <a href=\"mailto:bookcom@bankstreet.edu\">contact Bank Street<\/a> about including plagiarized work on their book list.<\/p>\n<p><strong>Maya Gonzalez created The Gender Wheel and brought a holistic, nature-based vision of gender to kids. Her primary tool of activism is creating and publishing radical children&#8217;s books that tell the truth of who we are and what we can be. She has been a close ally of the trans community for over 30 years and her partner is trans.
